1. Scope and acceptance
These terms apply whenever you visit an EBAT website, create an account, submit an inquiry, subscribe to communications or use another service that links to them. Additional written terms may apply to a proposal, statement of work, license, purchase or managed service.
If additional terms conflict with these terms, the additional terms control for the specific product, project or transaction they address. If you use a service on behalf of an organization, you confirm that you have authority to bind that organization.
2. Accounts and credentials
You must provide accurate information, keep it reasonably current and protect your password, session and other credentials. You are responsible for activity performed through your account unless you promptly notify us of suspected unauthorized access.
We may require verification, refuse registration, suspend credentials or request additional information when reasonably necessary to protect users, EBAT or the integrity of a service. You may not transfer, sell or share an account in a way that defeats access controls.
3. Permitted use
You may use the services for lawful business, research and informational purposes in accordance with documentation and any agreed service limits. You must also follow the Acceptable Use Policy, which forms part of these terms.
Technical examples, estimates, articles and other public materials are general information. They are not a substitute for site-specific engineering analysis, safety review, professional advice or a signed project agreement.
4. Your content and feedback
You retain ownership of information, files and other material you submit. You grant EBAT the limited rights needed to receive, secure, process and respond to that material, provide the requested service and comply with law.
Do not send confidential design data, export-controlled material, regulated personal data or third-party secrets through a public form unless EBAT has expressly approved a suitable channel. Feedback may be used to improve our services without payment or restriction, provided we do not identify you without permission.
5. EBAT materials and intellectual property
The services and their software, visual identity, text, diagrams, media and documentation are owned by EBAT or its licensors and are protected by applicable intellectual property laws. Except for ordinary access and use, no rights are granted by implication.
You may not copy, publish, modify, reverse engineer, remove notices from or commercially exploit EBAT materials unless law permits it or EBAT has agreed in writing. EBAT names, marks and logos may not be used to imply endorsement or affiliation.
6. Availability and changes
We work to keep our digital services reliable, but availability is not guaranteed. Maintenance, security events, upstream providers, network conditions or events outside reasonable control may interrupt access.
We may change, add or retire online features and content. Material changes to these terms will be posted with a revised date. Continued use after the effective date means you accept the revised terms; where law requires additional notice or consent, we will provide it.
7. Disclaimers and responsibility
To the extent permitted by law, public digital services are provided on an "as available" basis without implied warranties of uninterrupted operation, merchantability, fitness for a particular purpose or non-infringement. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
To the extent permitted by law, EBAT is not liable for indirect, incidental, special, exemplary or consequential loss arising from public website use. Liability under a signed commercial agreement is governed by that agreement.
8. Suspension and termination
You may stop using a service at any time. We may restrict or terminate access when you materially breach these terms, create security or legal risk, fail to pay an applicable charge, or when a service is discontinued.
Provisions that by their nature should survive termination remain effective, including ownership, confidentiality obligations, disclaimers, responsibility limits and dispute provisions.
9. General terms
These terms and any incorporated policies are the entire agreement for the public digital services they cover. A failure to enforce a provision is not a waiver. If a provision is unenforceable, the remaining provisions continue in effect.
Applicable law and forum may depend on your location and any EBAT entity or commercial agreement involved. Mandatory consumer or data protection rights remain unaffected. Before starting formal proceedings, please contact us so the issue can be assessed and, where possible, resolved.
